Road Traffic Act, 1976 (No 48 of 1976) — s 56(10) — application forprohibition from driving to be set aside — procedure.
In making an application to set aside an order prohibiting a person from driving for life the correct procedure is to make application on notice of motion to the High Court. Whilst the Act is silent on the point, the only person qualified to act in the interests of the State is the Attorney-General, upon whom the notice of motion should be served and who is thereafter best able to assist the court in determining the application.
