Husband and wife — maintenance pendente lite — no order possible by High Court when an order as to maintenance exists — status of order of maintenance by community court.
The High Court will not, save in exceptional circumstances, entertain applications for maintenance pendente lite where there is already in existence an order of the magistrates court on the matter.
The proper course is for an application to be made in that court for a variation or discharge of that order before an application is made to the High Court. A community court established in terms of the Customary Law and Primary Courts Act, 1981 (No. 6 of 1981), enjoys concurrent jurisdiction with the magistrates court on the issue of maintenance.
