Insurance — interpretation of words in contracts of insurance — "theft" — the criminal definition of "theft" applies when that word is used in an insurance policy.
If a word has an accepted legal definition that definition will apply when it is used in a contract of insurance. The word "theft" is well established as a term of legal art in our criminal law. It is the definition of theft in our criminal law which governs its interpretation in the policy insurance under consideration.
Where a person enters a contract with another party, which contract gives rise to a duty of care in respect of the property of one party, a duty of care in respect of the property of a person who is not a party to the contract can arise. Such duty of care cannot extend beyond the obligations incumbent upon the party in terms of the contract. Whether there is a breach of duty is a factual question to be decided in respect of each set of circumstances.
