Contract — suspensive and resolute conditions — effect of failure to comply with conditions — condition inserted for the benefit of one party — waiver of such a condition — distinction between suspensive and resolute conditions.
In an agreement of sale of immovable property two special conditions were inserted. One condition was that the purchaser obtained a loan by a certain date and the other was that the purchaser sold another property belonging to him by a certain date. There was one general clause relating to the giving of notice in the event of the purchaser being in default of any condition.
Held, that where a condition of a contract is for the sole benefit of one party and that party has to perform on or before a fixed date, he can only waive such condition on notice being given to the other party before the fixed date.
