Company — winding up — application for — requirement to serve notice on company itself — company's right to put forward c grounds of opposition to application
Where an application is made for the winding up of a company, notice must be served on the respondent company. The company has a right to put forward its opposition to the grant of an order for winding up. The change to the High Court Rules, removing procedure by way of petition, does not alter the requirement imposed by the Companies (Winding Up) Rules 1974 to serve a copy of the petition and the notice of set-down for hearing on the company.
