Where paternity is in issue, a maintenance court has not only the power but the duty to conduct an enquiry into the matter, calling such witnesses as it deems fit. If necessary, the court should see the child. If the alleged father shows that the woman was married to another man, this does not end the matter. If he has admitted intercourse, he is presumed to be the father unless he proves that he cannot be the father.
