The rights as between peggers of mining locations are determined by priority of acquisition of title, the rights of a later pegger being subordinate to those of an earlier one. Title to a mining claim is acquired by the due performance of the first physical action required to be done under the Mines and Minerals Act, that is, by visiting the mining location and doing something such as pegging a claim. Merely filing an application is not a "physical" act as envisaged by the Act.
