C Elections — election petition — dismissal for want of prosecution — how to be effected
There being no provision in the Electoral Act [Chapter 2:01] dealing with dismissal of an election petition for want of prosecution, the court relied on O 9 r 62 of the High Court Rules, 1971, to order absolution from the instance in favour of the respondent, where the petitioner had failed to appear after three postponements. The court also ordered the petitioner to pay costs on the legal practitioner and client scale.
