Town and country planning — title deed conditions — planning authority can permit use contrary to conditions
A town planning authority can permit an owner of a stand to do something which is contrary to the conditions contained in his title deeds. This is so because s 27 of the Regional, Town and Country Planning Act 1976 requires it to notify the Registrar of Deeds so he can delete relevant conditions. But before the town planning authority authorises any use contrary to the title deed conditions it must comply with s 27(3) of the Act, that notice of the proposed use must be given to the neighbours.
