An 18-year-old unmarried woman had given birth and then killed her newly born child by throwing it into an ant-bear hole. A few years previously she had given birth to another child which was being looked after by her brother. She was a first offender and pleaded guilty to the charge. The trial magistrate imposed a wholly suspended prison sentence upon her. The review court stated that the prison sentence should not have been wholly suspended. Despite the mitigating factors, infanticide is a serious crime and the accused was not a stranger to the process of giving birth and her fear of not being able to look after the second child was lessened by the fact that she was employed and her first child was being looked after by her brother.
