Criminal C procedure — trial — conduct of — plea of not guilty to one charge and guilty to another — irregular to proceed to verdict and sentence on latter before doing so in respect of first charge.
Where an accused person is charged at the same time with more than one offence, it is irregular for the trial court to dispose of one of those counts in its entirety before dealing with the others. Verdict on all counts should be pronounced at one and the same time. One reason for this is that it wrong to subject the accused to the additional expense and the general inconvenience of standing trial for a second time on the same charge sheet. Another reason is that the facts may be such that any sentence on the count that is dealt with later would, when considered in the light of the sentence already passed, be excessive.
