On charge of unlawful possession of uncut emeralds under section 3 (1) of the Precious Stones Trade Act (No. 8 of 1978), it is not necessary for the prosecution to establish legal possession; the section penalises detention, or custody or control. Thus, where the respondent kept 6 emeralds for another man, to return to him later in the day, his custody of the emeralds during that time amounted to possession.
