The respondent was born in Zimbabwe to parents who were born in New Zealand. The appellant claimed that because she had failed to renounce her New Zealand citizenship she ceased to be a citizen of Zimbabwe.
Held, that in terms of the New Zealand legislation, the respondent was a citizen of New Zealand and had to renounce that citizenship in order to remain a citizen of Zimbabwe.
Held, further, that although she had not renounced her New Zealand citizenship by the date set out in the Citizenship Act, as amended, she had instituted proceedings two days before that date, and this suspended the requirement to renounce by the given date. The court allowed her two days from the announcement of judgment to renounce New Zealand citizenship or lose her Zimbabwe citizenship.
