Criminal procedure — suspended sentence — conditions of suspension — condition that accused does not commit "any offence involving theft or dishonesty" — section 48(1)(a) of Road Traffic Act 1976 (interfering with a motor vehicle) not necessarily such an offence.
Where a sentence is suspended on condition that the accused does not commit an offence involving dishonesty, it can only be brought into operation if he is convicted of an offence of a kindred nature to theft. The offence of interfering with a motor vehicle, in contravention of section 48(1)(a) of the Road Traffic Act 1976, does not necessarily involve dishonesty and is not necessarily of a kindred nature to theft, so it cannot be inferred that the accused ought to have understood that if he was to commit that offence he would be liable to have the suspended sentence activated.
